Welcome to SHEER Personality. These Terms of Use (“Terms”) govern your access to and use of sheerpersonality.com, the SHEER assessment, your SHEER Profile and Insight Map, Iris, and any related products, tools, content, or services (collectively, the “Services”).

SHEER Personality is operated by Reladium LLC, doing business as SHEER Personality (“SHEER,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not access or use the Services.

You must be at least 18 years old and legally able to enter into a binding agreement to use the Services.

By using SHEER, you represent that you meet these requirements and that the information you provide is accurate and current.

Some features may require you to create an account.

You are responsible for:

• Providing accurate and complete account information
• Keeping your login credentials confidential
• Maintaining the security of your account
• Promptly notifying us at hello@sheerpersonality.com if you believe your account has been accessed without authorization

You are responsible for activity that occurs through your account unless caused by our failure to maintain reasonable security measures.

We may suspend or terminate accounts that contain inaccurate information, violate these Terms, create security risks, or are used in a way that may harm SHEER, other users, or third parties.

SHEER is a personality and relational insight framework. It is designed to help users reflect on their tendencies, communication styles, decision-making patterns, emotional orientation, and relational dynamics.

Your assessment results, SHEER Profile, Insight Map, Iris responses, and any future overlay insights are intended for personal reflection, learning, and conversation.

They are not:

• Medical, mental health, psychological, psychiatric, or clinical evaluations
• Diagnostic tools
• Therapy, counseling, or crisis services
• Legal, financial, career, or professional advice
• Guarantees of compatibility, success, relationship outcomes, or behavior
• A substitute for qualified professional support

You are responsible for how you interpret and use insights generated through the Services.

Do not use SHEER as the sole basis for hiring, firing, promotion, discipline, compensation, admissions, medical treatment, insurance, credit, housing, legal decisions, or other high-impact decisions about another person.

Iris is an AI-assisted insight companion that may respond to questions using your SHEER information and the context you provide.

Iris may occasionally generate inaccurate, incomplete, or unhelpful responses. You should use judgment and should not rely on Iris as a substitute for professional advice.

Do not submit highly sensitive information through Iris, including passwords, Social Security numbers, financial account details, medical records, or information you would not want processed through an AI-enabled service.

If you are experiencing an emergency or crisis, contact local emergency services, call or text 988 in the United States, or contact a qualified crisis or mental health professional.

You may use the Services only for lawful, personal, internal business, or authorized organizational purposes.

You may not:

• Impersonate another person or misrepresent your identity
• Take the assessment on behalf of another person without their knowledge and consent
• Use another person’s SHEER results without their permission
• Harass, threaten, exploit, discriminate against, or harm another person through the Services
• Submit unlawful, defamatory, abusive, hateful, obscene, or infringing content
• Attempt to access accounts, systems, data, or features you are not authorized to access
• Interfere with the operation, security, or availability of the Services
• Use bots, scrapers, crawlers, data-mining tools, or other automated methods to access or extract content or data from the Services
• Reverse engineer, decompile, copy, recreate, benchmark, or attempt to discover the underlying logic, scoring, prompts, methodology, or source code of SHEER
• Use SHEER content, assessment questions, results, or Iris outputs to create, train, improve, or support a competing product or service without our written permission
• Use the Services in violation of applicable law or these Terms

You retain ownership of the information and content you provide to SHEER, including assessment responses, questions submitted to Iris, and feedback you share with us.

You grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, analyze, store, reproduce, and use that information only as necessary to operate, improve, secure, and provide the Services.

We may use de-identified or aggregated information to understand trends, improve the assessment and Services, and develop future features. This information will not reasonably identify you.

If you provide feedback, suggestions, ideas, or recommendations about SHEER, you grant us the right to use them without restriction or compensation to you.

SHEER may offer optional features that allow people to compare or explore personality dynamics within a relationship, partnership, team, family, coaching engagement, or group.

Participation in these features is voluntary. You may not upload, share, or submit another person’s information or assessment results without their knowledge and consent.

SHEER does not guarantee that overlays or group insights will produce accurate predictions, resolve conflict, improve relationships, or create any particular outcome.

The Services, including the SHEER name, logo, assessment questions, scoring framework, dimensions, insights, reports, text, design, software, graphics, and other content are owned by or licensed to Reladium LLC and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-transferable, revocable right to access and use the Services for their intended purpose.

You may not copy, reproduce, publish, distribute, sell, license, modify, publicly display, create derivative works from, or exploit SHEER content without our prior written permission.

You may share your own personal SHEER results for non-commercial purposes, provided you do not remove branding, misrepresent the content, or imply endorsement by SHEER.

SHEER may offer free and paid products, including paid access to an Insight Map, Iris interactions, overlays, subscriptions, or other future features.

Prices, product descriptions, billing terms, and payment requirements will be presented to you before purchase.

By making a purchase, you agree to:

• Provide accurate payment and billing information
• Pay all charges, taxes, and fees associated with your purchase
• Authorize us or our payment processor to charge your chosen payment method

Unless otherwise stated at checkout or required by applicable law, purchases of digital products and Services are non-refundable once access has been provided.

If SHEER offers a recurring subscription in the future, the recurring billing terms, amount, frequency, cancellation method, and renewal details will be clearly disclosed before you enroll. You may cancel a subscription according to the instructions provided at the time of purchase or within your account settings.

You may stop using the Services at any time.

You may request deletion of your account by contacting hello@sheerpersonality.com. Account deletion is subject to the retention practices described in our Privacy Policy.

We may suspend or terminate your access to the Services if we reasonably believe that you have violated these Terms, created a risk of harm, engaged in unlawful activity, or used the Services in a way that could damage SHEER or others.

Termination does not affect any rights or obligations that arose before termination.

The Services may rely on or link to third-party services, including payment processors, hosting providers, analytics providers, AI providers, and external websites.

We are not responsible for third-party services, their content, availability, security, or privacy practices. Your use of third-party services may be governed by their separate terms and privacy policies.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE FULLEST EXTENT PERMITTED BY LAW, SHEER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, OR SECURITY.

WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS, OR THAT ANY INSIGHT, SCORE, RESPONSE, OR RECOMMENDATION WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PARTICULAR SITUATION.

TO THE FULLEST EXTENT PERMITTED BY LAW, RELADIUM LLC, SHEER PERSONALITY, AND OUR AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

THIS INCLUDES LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, RELATIONSHIP OUTCOMES, OR OTHER INTANGIBLE LOSSES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO SHEER FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

You agree to indemnify and hold harmless Reladium LLC, SHEER Personality, and our affiliates, officers, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of another person’s rights
• Your misuse of SHEER results, Iris, overlays, or other Services
• Content or information you submit through the Services

We may modify, suspend, discontinue, or update the Services at any time.

We may also update these Terms from time to time. When we do, we will update the Effective Date above.

If we make material changes, we may provide notice through the website, your account, or by email. Your continued use of the Services after updated Terms become effective means you accept the revised Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Services will be brought exclusively in the state courts located in Placer County, California, or the federal courts located in the Eastern District of California. You consent to the personal jurisdiction of those courts.

These Terms, together with our Privacy Policy and any additional terms presented for specific features or purchases, form the entire agreement between you and SHEER regarding the Services.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, or similar transaction.
